Photo Booth Customer Terms
Open Booths Australia Pty Ltd (ABN 28 602 891 887, ACN 602 891 887) trading as Open Booths (we, us, our)
1. These terms
1.1 These terms apply when you use a self-service Open Booths photo booth at one of our venue locations. By starting a session and tapping to pay, you accept them.
1.2 Our handling of your personal information — including your photos and any contact details you enter — is described in our Privacy Policy at www.openbooths.com.au, which applies alongside these terms.
1.3 In these terms, a session is a single paid use of a booth, and booth content means the photos, videos, GIFs and prints created during your session.
2. Payment
2.1 The price of a session is shown on screen before you pay. Prices are in Australian dollars and include GST.
2.2 By presenting your card or device to the payment terminal, you authorise us to charge the amount shown. Your session starts once payment is approved.
3. Getting your photos
3.1 Booth content is delivered by the options shown on screen at that booth — printing, email, SMS or QR download — which vary by location.
3.2 If you choose digital delivery, please enter your contact details carefully and check your junk folder if nothing arrives promptly. Delivery relies on networks, email providers and your device, which we don't control.
3.3 Digital copies stay available for the retention period in our Privacy Policy (currently 12 months from your session), then they're deleted — so please save them within that time.
4. Refunds
4.1 Our services come with guarantees under the Australian Consumer Law that can't be excluded. Nothing in these terms limits those rights.
4.2 If a booth takes your payment but doesn't deliver your session — a camera fault, a jammed print, a software error — we'll give you a replacement session or a refund of what you paid.
4.3 To make a claim, email support@openbooths.com.au or call 1300 766 553 with the venue, the rough date and time, and the last four digits of the card you used. Most claims are sorted within 5 business days.
4.4 We can't refund a completed session where the contact details entered were incorrect, your inbox or device rejected the delivery, or the session was abandoned partway — except where the Australian Consumer Law says otherwise. Apart from that, payments are final and we don't offer change-of-mind refunds.
5. Your photos are yours
5.1 You own the rights in the images and videos of you created during your session, and you can use them for personal, non-commercial purposes however you like.
5.2 You give us permission to capture, process, store and deliver your booth content — solely so we can provide the service, and only for the retention period in our Privacy Policy.
5.3 We never use your photos or videos in our marketing, or share them with the venue for theirs, unless you expressly opt in via the consent options on the booth screen. Saying no changes nothing about your session.
5.4 The Open Booths name, branding, booth designs and software remain ours.
6. Other people in your photos
6.1 Before a group session, make sure everyone in frame is happy to be photographed and to receive the content by your chosen delivery method. That agreement is your responsibility, and the booth will ask you to confirm it.
7. Behaviour and venue rules
7.1 Booths sit inside venues with their own entry conditions, which also apply to you. Please follow reasonable directions from venue staff.
7.2 Don't use a booth to create content that is unlawful, threatening, harassing or defamatory, and don't damage, tamper with or move a booth. We or the venue may end a session or decline further use where this is breached.
7.3 If you're under 18 and lawfully at the venue, please only use a booth with a parent or guardian's consent and supervision — they accept these terms for you. Venue age restrictions always prevail.
8. Availability
8.1 Booths are self-service and occasionally offline for maintenance, restocking or updates. We don't guarantee a booth will be running at any particular time — and you're never charged for a booth that isn't.
8.2 We're not liable for delays or failures caused by things beyond our reasonable control, such as power or network outages or venue closures.
9. Liability
9.1 Where the Australian Consumer Law lets us limit liability for a service failure, our liability is limited, at our option, to supplying the session again or paying the cost of having it supplied again.
9.2 To the extent the law permits, we're not liable for indirect or consequential loss, and our liability is reduced to the extent your actions caused or contributed to the loss.
9.3 You're responsible for loss or claims we face to the extent they arise from your breach of these terms or unlawful use of a booth or booth content.
10. General
10.1 These terms are governed by the laws of New South Wales, including for booths located in other states, and the parties submit to the non-exclusive jurisdiction of its courts.
10.2 If part of these terms can't be enforced, the rest still applies. We may update these terms; the version in force when you start a session is the one that applies to it.
